Ownership of Site; Agreement to Terms of Use
The Grand Funding service and website (each as defined below) are operated by Grand Funding, its parents, subsidiaries, and affiliates doing business under the Grand Funding brand (collectively, “Grand Funding,” “we,” “our,” or “us”). Grand Funding provides customers with small business loans, lines of credit, credit servicing, and related services (the “Service” or “Services”). Grand Funding is not an investment advisor or financial planner, and we do not provide financial, securities, legal, or tax advice. Before making any decision or implementing any strategy, you should consider obtaining additional information and advice from your accountant, attorney, and/or other advisors. “You” refers to the individual using the Website (defined below) and the company engaging with the Services. Unless otherwise noted, any agreements, authorizations, or consents made by you or permissions granted to you hereunder also apply and are binding on your company seeking our Services.
By using the information, tools, features, and functionality located at grandfunding.com or subdomains (the “Website”) or by submitting a credit application to Grand Funding, you acknowledge that you have read, understand, and agree to be bound by these Terms of Use (the “Agreement”). You further agree that all information provided by your company as the borrower and/or by you (either as a guarantor or as an authorized representative of your company) during the application process or in connection with Grand Funding’s Services is accurate and complete.
You may not use the Services if you are under 18 years of age. BY USING THE WEBSITE OR APPLYING FOR OR USING ANY OF THE SERVICES, YOU REPRESENT AND WARRANT THAT YOU ARE AT LEAST 18 YEARS OF AGE OR THAT YOU MEET THE MINIMUM AGE REQUIRED IN YOUR STATE AND ARE A LEGAL RESIDENT OF THE UNITED STATES. You further represent that you have the authority to bind the company or entity applying for credit. You understand that (a) we will require a personal guarantee for any credit obtained by your company from Grand Funding, and (b) for term loans, we will take a general lien on your business’s assets. Before using the Services or submitting an application, you should print or save a copy of this Agreement.
In addition to this Agreement, you and your company may enter into other agreements, including, without limitation, a loan agreement or promissory note governing the terms of your company’s loan or line of credit and use of the Service (“Additional Agreement(s)”). Any Additional Agreements are intended to supplement this Agreement, which remains in full force and effect. In the event of a conflict between this Agreement and any Additional Agreement, the Additional Agreement shall govern with respect to the specific aspects addressed therein, without affecting the validity of any other part of this Agreement.
Modifications
Grand Funding may update this Agreement from time to time at our discretion. The “Last Updated” date at the top of this page reflects the most recent revisions. Your continued use of the Services or Website after updates constitutes acceptance of the revised terms. While we may notify you of changes, you are responsible for periodically reviewing this page, as the revisions are binding whether or not notice is provided.
Credit and Background Check Authorization
You understand and agree that by submitting an application to Grand Funding, Grand Funding and its agents, affiliates, and assignees may contact third parties to conduct background checks, obtain documents or data reasonably necessary to assess your eligibility, including business credit card sales data, and perform credit report inquiries (personal and business). This authority applies to initial credit approval, ongoing loan reviews, renewals, or referrals to third-party lenders. Grand Funding makes no guarantee that any evaluation or guidance provided will result in credit approval. Upon request, we will inform you if a credit report was obtained.
Registration
While some portions of the Website and Services are accessible without registration, certain functionalities require you to create a username and password. You may not share credentials. You are responsible for (i) maintaining account confidentiality, (ii) notifying us of any need to deactivate a username, and (iii) any charges or damages incurred under your account until such notice is provided. Grand Funding is not liable for authorized or unauthorized use of your account.
Information Collected and Used
Please review our Privacy Policy, incorporated herein by reference, for details on how Grand Funding collects, uses, and protects your personal and company information.
Information You Provide: This may include name, address, email, phone numbers, account and financial information, date of birth, Social Security Number, and government-issued IDs.
Information Collected Automatically: IP address, geolocation, device information, and website activity via Google Analytics, FullStory, LiveRamp, and other cookies or tracking technologies. This data helps improve Services and may be used for advertising purposes.
Use of the Website; Acceptable Use
You may only use the Website for lawful purposes. You agree not to:
- Impair or overburden the Website;
- Use automated devices or scripts to collect data without consent;
- Attempt unauthorized access;
- Violate applicable laws; or
- Engage in activity that damages Grand Funding or third parties.

Limitation of Liability
To the maximum extent allowed by law, Grand Funding and its affiliates are not liable for indirect, incidental, special, or punitive damages, or loss of profits. Total liability is limited to amounts paid to Grand Funding for Services during the six months prior to the claim.
Indemnification
You agree to defend and hold harmless Grand Funding and its affiliates from claims, losses, or damages arising from your use of the Website, violation of this Agreement, infringement of third-party rights, or content submitted.
Termination
Grand Funding may suspend or terminate access at any time. Certain sections (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) survive termination.
Governing Law
This Agreement is governed by the laws of the state where Grand Funding is headquartered, without regard to conflict of law principles.
Dispute Resolution; Arbitration
Disputes shall first be resolved in good faith negotiation, then by binding arbitration in the state of Grand Funding’s headquarters. Each party bears its own costs unless the arbitrator decides otherwise.
Waiver and Severability
No waiver constitutes a continuing waiver. Invalid provisions do not affect remaining provisions.
Modifications to Terms
Grand Funding may update these Terms at any time. Continued use of the Website constitutes acceptance of revised Terms.
Entire Agreement
This Agreement constitutes the complete agreement between you and Grand Funding regarding the Website and Services.
